Employee State Insurance (ESI) is a scheme introduced by Government of India under The Employees’ State Insurance Act, 1948. ESI Scheme is an integrated social security scheme tailored to provide social protection to workers and their dependents in contingencies, such as sickness, maternity and death or disablement due to an employment injury or occupational hazard.

Applicability

ESI Registration is mandatory for following establishments–

  • all non-seasonal factories employing 10 or more persons
  • Shops, Hotels, Restaurants, Road Motor Transport establishments, Cinema, Newspaper establishments, Insurance Business, Non-Banking Financial Companies, Port Trust, Airport Authorities, Warehousing establishments employing 20 or more persons/ 10 or more persons based on state laws.

The establishment has to mandatorily register itself with the ESIC within 15 days from the date of its applicability.

ApplicabilityRegistration Procedure

  1. File an application (Form-01) in ESIC portal and submit all required documents.
  2. After submission of Form-01, payment of advance contribution for 6 months shall be made.
  3. After successful payment & verification, proper officer issues registration letter (C-11) containing 17-digit Registration number.

Penalty

Rs.10,000 for non-compliance.

Compliance

Half-yearly return of ESIC is filed online Due date for the returns are-

  • For the period April to September is due by 12th November and
  • For October to March is due by 12th May..

Monthly payment of esi contribution is made online and a challan is generated on payment.

Consequences of Delayed Payment

An employer who fails to pay the contribution within the limit specified in the regulation shall be liable to pay simple interest at the rate of 12% per annum in respect of each day of delay or default in payment of contribution.
